Pedestrian Fatality on Hwy 101 in Lane County Highlights Safety Concerns

Lane County, Oregon | November 23, 2024 - A somber incident unfolded on the evening of November 23, 2024, as Garrick Wall, 40, of Florence, was fatally struck by a vehicle on Hwy 101 near milepost 192. The Oregon State Police responded promptly to the scene following the tragic event involving a GMC Terrain driven by James Harpole, 58, from Cheshire.

Incident Details

The investigation indicated that Wall was walking on the northbound shoulder, attempting to cross an unlighted, non-crosswalk section of the highway near S. Loftus Road. Unfortunately, while crossing in dark-colored clothing, Wall was struck in the left southbound lane by Harpole's vehicle. Wall was declared deceased at the scene, while Harpole and his passenger, Charlene Lohf, 58, remained uninjured.

The highway was significantly impacted for approximately three hours during the thorough on-scene investigation conducted by multiple agencies, including the Oregon State Police, Western Lane EMS, Siuslaw Valley Fire Department, Florence Police Department, and ODOT.

Legal Implications and Safety Concerns

This incident brings to light several critical issues concerning pedestrian safety and driver responsibility on Oregon's roads. Pedestrian fatalities such as this can involve complex legal considerations, including determining liability and evaluating the circumstances that contributed to the accident.

Under Oregon law, drivers have an obligation to exercise due care to avoid colliding with pedestrians. However, pedestrians also have responsibilities, such as using crosswalks and ensuring visibility, especially in low-light conditions. The unfortunate occurrence on Hwy 101 underscores the necessity for both drivers and pedestrians to remain vigilant and prioritize safety.

Promoting Public Safety

The Oregon State Police Collision Reconstruction Unit (CRU) plays a pivotal role in investigating such fatal incidents. Their expertise in documentation and analysis is vital for determining factors that contribute to accidents, potentially leading to improvements in road safety measures.
