Douglas County, Oregon | December 2, 2024
A fatal crash involving two commercial motor vehicles occurred late Monday night, December 2, on Interstate 5 near milepost 161 in Douglas County. Oregon State Police (OSP) responded to the scene at approximately 11:43 p.m. and have launched an investigation into the circumstances surrounding the collision.
Details of the Crash
According to the preliminary investigation by OSP, a Volvo semi-truck and trailer, driven southbound by 51-year-old Sargis Sargsyan of Glendale, California, veered off the roadway for unknown reasons. The vehicle subsequently slammed into the rear of a parked Peterbilt semi-truck and trailer.
The parked vehicle was occupied by Oleksandra Kepina, 29, and Ihor Vasylevskyi, 36, both of Rockville, Maryland. Fortunately, neither occupant was injured in the crash. Tragically, Sargsyan was pronounced dead at the scene.
OSP’s Collision Reconstruction Unit (CRU), which specializes in analyzing serious and fatal vehicle crashes, was the lead investigative team on-site. Their role includes documenting crash scenes using advanced measurement tools and small unmanned aircraft systems (sUAS), offering critical insights into collision causation.
Legal and Safety Implications
This incident highlights several key issues under Oregon personal injury and wrongful death law. When a fatal crash involves a commercial truck, questions often arise about the conditions leading to the collision, such as vehicle maintenance, driver fatigue, or possible mechanical failure. These factors may be crucial in determining liability under Oregon’s wrongful death statutes.
In cases like this, surviving family members of the deceased may pursue a claim for wrongful death, especially if negligence by a third party—such as an employer, maintenance contractor, or another driver—contributed to the crash. Even though no other injuries were reported, the occupants of the parked semi-truck may still have grounds to pursue claims for emotional distress or personal injury if further issues develop.
Additionally, because both vehicles involved were commercial trucks, this case may involve complex issues of federal and state trucking regulations. Parties injured in commercial vehicle collisions often face aggressive defense tactics from transportation companies and their insurers, making the presence of experienced legal counsel crucial.
Promoting Roadside Safety
This fatality also underscores the ongoing safety concerns regarding parked vehicles on highways. Commercial drivers often find themselves with limited options for safe overnight parking, particularly along long stretches of highway like I-5. The positioning of parked vehicles near active lanes of traffic can significantly heighten the risk of collisions.
Oregon law does regulate roadside parking of commercial vehicles, but enforcement and infrastructure challenges remain. Greater investment in designated rest areas and overnight truck parking could help mitigate these risks.
