The most recent changes to the law were enacted by House Bill (HB) 3223, which was passed in 2019 and signed into law by Governor Kate Brown. This bill increased fines for those convicted of Driving Under the Influence (DUI) or Driving While Intoxicated (DWI). It also doubled jail time for those convicted of causing injury while driving under the influence or while intoxicated, with a minimum sentence of one year in jail and an additional two years if serious physical injury is caused. There are also new provisions that allow prosecutors to charge DUI offenses as felonies if they involve serious injury or death.
These laws are just part of a larger effort by Oregon legislators to target drunk driving offenders who cause injury or death on our roads. In 2017, HB 2314 was passed which allowed prosecutors to charge those involved in fatal DUI accidents with first-degree manslaughter if aggravating circumstances are present such as fleeing from police following an accident or having multiple DUIs on record already.
